After a discussion with the director of “Dawnland”, Adam Mazo, about the first ever government-endorsed truth and reconciliation commission (TRC) in the U.S., an abbreviated version of the film will be screened. “Dawnland” documents the historic investigation into child welfare authorities’ removal of Indigenous children from their families with efforts to erase their culture. This presentation will also discuss the Indian Child Welfare Act, the pending case Brackeen v. Darrow’s Nightmare and the Ethics of Advocacy

"Darrow’s Nightmare” is the fourth book and second legal history of New York Times best-selling author of “Boardwalk Empire,” Judge Nelson Johnson. This time his focus is upon the events in a courtroom in Los Angeles, where legendary lawyer Clarence Darrow was a criminal defendant himself.
    
Judge Johnson’s book is not a biography but rather recounts the worst two years (1911-13) in the lives of Darrow and his wife Ruby. Johnson is the first author to make extensive use of the 8,000(+) page trial transcript of the twelve-week jury trial. Darrow had gone to Chicago to represent two brothers - union members - charged with bombing the Los Angeles Times building and murdering 20 employees. L.A. politics was toxic and Darrow became ensnared in a situation beyond his control. In addition to reviving a long-forgotten chapter in Darrow’s career, the reader is introduced to courtroom impresario, Earl Rogers who defended Darrow. Johnson believes that but for Rogers, Darrow might have become little more than a footnote in the history of the American labor movement.
    
“Darrow’s Nightmare” is a story like no other, rich with do’s and don’ts and multiple learning opportunities for judges and lawyers alike.

Media law scholars, commentators and jurists have long agreed: if the First Amendment protections mean anything, they do not allow the government to restrain publication before it occurs – “censorship.” From the landmark Pentagon Papers case to the present, it has long been an unquestioned assumption that the government cannot prohibit or impose terms on speech prior to publication. Yet the latest trends from the Trump and post-Trump era suggest changing attitudes towards the media and the newest media paradigm, Social Media/Tech Platforms, suggest that judges, politicians and the public want to rein in the media in ways at odds with traditional First Amendment values. From the recent Project Veritas decision in New York restraining the New York Times from publishing, to proposals to  require moderation of content on social media, we explore through First Amendment experts and practitioners the state of the law on prior restraint and tech content moderation.

Although litigation is an inherently adversarial process, it does not have to be uncivil. This discussion will focus on the importance on how civility, etiquette, and professional courtesy in the courtroom, and in other legal situations, improves the practice of law. Ethical rules and the rules of civil procedure govern the conduct of lawyers in litigation, but interactions with clients, opposing counsel and the court should be controlled by broader principles of civility. It is important to not only be properly prepared for any type of scenario but learn to balance the relationship and expectations of clients in order to deliver the best possible outcome.

Beyond Andujar: A Deeper Dive

The historic Supreme Court decision in State v. Andujar addressed the longstanding problem of unconscious racial bias that occurs in our jury selection process. The High Court unanimously ruled that selective background checks are discriminatory, and that implicit bias is impermissible in the jury selection process. In response to the Andujar decision, statewide efforts to reform jury selection have been underway. Criminal and civil practitioners alike have committed to “tackling the problem”, “getting this right” and “doing better”. The bench and bar have collectively established committees, written articles, held round table discussions, convened for the judicial conference on jury selection and provided extensive reports from the most distinguished trial lawyers in the field on how to best reform the jury selection process. These efforts are both laudable and indeed necessary, but does it lead to the true reform that our jurisprudence needs?
    
The Minorities in the Profession Section of the NJSBA invites you to join us for an illuminating, robust, and analytical discussion of impressions from the Andujar case and how practitioners can dive deeper to effectuate real reform in their daily practice. The moderator along with a distinguished panel will discuss the scope of the Andujar decision and its impact on the following: jury selection, discriminatory background checks, implicit bias across practice areas, juror engagement, the school to prison pipeline, the foster care to prison pipeline, the reasonable child standard, changing the face of NJ prisons, NJ trial/criminal conviction rates… and more. AI touches almost every aspect of our daily lives. Currently, AI is used by many companies in all stages of the employment relationship, beginning with the application, interview and hiring processes. Some of AI’s key objectives are to eliminate human errors and biases that can taint employment decisions. In this way, proponents argue that AI enlarges the pool of potential applicants in a quick, efficient and cost-effective manner while significantly reducing the chances that discrimination has infiltrated the process. On the other hand, critics argue that AI is not a magical solution to rooting out discrimination in the employment process because the algorithms, on which the employment decisions are ultimately based, can be infected by implicit bias. This panel will discuss the pros and cons of using AI in employment decisions and provide recommendations on “debiasing” the algorithms.

This panel will be composed of individuals in various areas of immigration law, from those dealing with removal defense, to affirmative petitions in dealing with same-sex marriages, business immigration, asylum law (LGBTQ issues), pro bono organizations, immigration volunteers. The purpose of the program is to discuss the diverse issues that non-citizens face upon being thrust into the immigration process in the United States. Whether they are submitting themselves at the border and into the asylum process (Afghan nationals after evacuation); or they are working for a multinational company in the US, but racially and culturally ostracized from their families (H1Bs), there are a series of issues that our clients face and we will be addressing what responsibility we may have to address and understand some of those issues as they arise. The topics covered.

I. Language – interpreters/speaking the same “language” and understanding our clients.
II. Cultural/Religious requirements that clients have or need that may seem foreign
III. Sensitivity – such as responding to LGBTQ client concerns, and should attorneys familiarize themselves with commonplace cultural idiosyncrasies of their client population to better set them at ease (greeting with Afghan nationals)
IV. Implicit bias in the EOIR removal system, USCIS interview process, and most facets of government bureaucracy with regard to non-citizens.

Second Chances: Recovery Courts and Expungements: Success After Addiction

Nikki Tierney was an attorney and is the mother of four. When she lost custody of her children, she was relegated to supervised parenting time, during which she was arrested and charged with second-degree felony child endangerment for an addiction-related incident. Facing seven years in prison, she pled guilty to third-degree child endangerment and was soon disbarred and admitted to drug court. Fourteen years later, she is in recovery, regained custody of her children and became an advocate for recovery and second chances – launching “Hope is Never Lost.” But her felony charge led to being denied a license to become a counselor and completing graduate school. She was barred from coaching her child’s sports team, volunteering at her children’s schools, and jobs. She wanted her charge expunged, but the law would not permit it even when a judge said she wanted to grant it. This year the Governor signed S2951/A4771 into law that expands offenses eligible for expungement upon a successful discharge from drug court. Hear from Tierney, recovery advocates and the sponsors about this incredible journey to second chances.

The New Jersey Insurance Fair Conduct Act: What You Must Know About This New Law

On Jan. 18, 2022, the Legislature enacted the New Jersey Insurance Fair Conduct Act. N.J.S.A. 17:29B(3)(a). The Act provides that claimants (persons injured in a motor vehicle accident and who have a claim for uninsured or underinsured motorist coverage) may file a civil action against their own automobile insurance company for the following reasons:
   

• The “unreasonable” denial of a claim for coverage or payment of benefits.
• The “unreasonable” delay for coverage or payment of benefits.
• Any violation of the Unfair Claim and Settlement Practices Act.

While the New Jersey Insurance Fair Conduct Act clearly establishes a cause of action for the “unreasonable” delay and denial of first-party uninsured and underinsured motorist claims, the Act leaves many questions unanswered.

Achieving Justice: State v Ways - A Conversation with Justice Albin, Professor Jenny-Brooke Condon, and Anthony Ways. Moderated by Prof. Charles Ray

In 1991, Anthony Ways was convicted of committing a murder during a botched armed robbery of two young men who were in Camden to buy drugs. He was sentenced to a term of life imprisonment. In 1995, Mr. Ways filed a petition for post-conviction relief (PCR) claiming that “newly discovered” evidence undermined the integrity of his conviction. In 2000, the PCR court held an evidentiary hearing but denied Ways' motion for a new trial. The Appellate Division affirmed. In 2004, the New Jersey Supreme Court reversed Mr. Way's conviction, vacated the judgment of conviction, finding that the newly discovered evidence created a probability that a new jury would render a not guilty verdict. A new trial was ordered. (See State v. Ways, 180 N.J. 171 (2004). 
    
After spending 13 years in prison, Mr. Ways was ultimately released and the State dismissed the murder and armed robbery charges filed against him.
    
This is a story about the checks and balances in our criminal justice system and about how the remedy of post-conviction relief gave Mr. Ways a “second chance” at life.  
   
Moderated by Rider University Professor Charles Ray, this will be a discussion between Anthony Ways and Justice Barry Albin, who wrote the opinion that overturned his conviction. They will discuss the case, the law and the pursuit of justice.

With an unprecedented number of cyberattacks in 2021, we do not expect 2022 to be much different. Unlike other threats to a business that are more sporadic, cybersecurity is a constant threat to the continuity of business operations. Even worse, no industry is immune  from attacks. Cyber experts universally agree that what is the most alluring to cybercriminals is large amounts of data. And what do industries of all types collect about their clients, customers, and even its own employees? Data.
   
In the current patchwork approach to cybersecurity and data privacy legal requirements, it can be challenging for a business to create a comprehensive privacy and security program that complies with the various (and sometimes conflicting) legal requirements. Building solutions that can be easily shifted to meet new and evolving legal requirements is key.
   
This Session will provide an explanation of recent threats to organizations and a detailed explanation of technology options. It will also include a discussion on security options for law firms and clients, what should be included in a written information security program (“WISP”), legal obligations facing the legal industry, contract provisions, breach response programs, and training.

This course deals with (1) the substance, underlying rationale, and the practical application of the Rules of Professional Conduct, particularly RPC 6.1: Voluntary Public Interest Legal Services and RPC 6.2: Acceptance of Appointments and (2) the professional obligations of the attorney to the client, the court, the public, and other lawyers.
    
Effective counsel is a prerequisite to the assertion of nearly every other fundamental right. As the Supreme Court observed, “it is through counsel that all other rights of the accused are protected: ‘Of all the rights that an accused person has, the right to be represented by counsel is by far the most pervasive, for it affects his (sic) ability to assert any other right he (sic) may have’” Penson, 488 U.S. at 84. While the State has the primary role in ensuring access to effective counsel in matters with “consequences of magnitude,” the courts and our profession have roles to play as well. This seminar will examine the underpinnings for right to counsel and the importance of access to counsel in all matters that affect fundamental rights. We will discuss the role of the State, the Court, the Bar, and individual attorneys in making access to counsel a reality for people with legal needs in New Jersey.
