Avoiding the Next Judicial Vacancy Crisis – Is it Time to Change How Judges are Appointed in New Jersey? will feature retired Supreme Court jurists, legislators and current and former government officials. This is an opportunity to hear from people who know first-hand what the judicial selection process involves, where the system needs improvement and what the vacancy crisis means to lawyers, litigants and the public.

The judicial vacancy crisis persists and, with it, constraints on an attorney’s ability to assist their clients in obtaining the best possible results in a timely manner. Litigants are stuck in limbo, qualified judicial candidates are put in a career holding pattern, and overworked judges are retiring before the mandatory age of 70, causing a self-perpetuating problem of a judicial shortage. 
   
In this special presentation, an esteemed panel of speakers from the highest levels of every branch of government will discuss the current state of judicial vacancies, the many unintended consequences of senatorial courtesy and some possible solutions for resolving this crisis.

Cyber Security and Safety in a Dangerous World: Review of Important International and Domestic Cyber Trends and Issues for the Legal Community

Cyber security and safety are of paramount concern to public officials and private citizens, including lawyers who do not practice in the technology space. Cyber security and safety concerns and risk grow each year in both influence and complexity internationally and domestically. Foreign and domestic political conflict and social strife can exacerbate cyber security and safety concerns and risks. For example, Russia’s war against the Ukraine has increased heightened cyber-attacks by sophisticated international hackers who seek to disrupt private and public entities from functioning or subject them to hacking, data theft and ransomware. Disinformation farms operating overseas have the ability to foment domestic civil unrest.  
      
New legal and regulatory challenges continue to emerge as technology infiltrates every aspect of public and private life since the internet is now the backbone of society and governs large aspects on civic and social engagement. In the public realm, the growing dominance of largely unregulated global tech companies presents grave concerns for lawmakers and regulators grappling with public health and safety, and security issues such as cyber exploitation and discrimination, digital harassment and violence, hate speech targeted towards vulnerable communities, and other online criminal activity such as human trafficking. Biases and discrimination programmed into artificial intelligence and big data using powerful algorithms can have a detrimental impact on targeted communities. While technology has benefits, it can also harm vulnerable and marginalized people—especially women and children and religious, ethnic and racial minorities —and threaten civil and human rights for all. Left unchecked, big tech amplifies all forms of discrimination and threatens the foundations of civil society and our collective humanity. This CLE program will review the scope of the legal issues relations to cyber security and safety and how legislatures and law enforcement are responding to the changing legal landscape both here and abroad.

Trends in Construction Arbitration

Dispute Resolution Track - Studio 3 
This program will provide some insights about construction arbitration and the trends that we have been experiencing since 2022. Given the backlog in state court trials, construction cases have to wait years for a jury trial. In light of this delay, as well as the cost involved in preparing and trying such a case, parties are turning to arbitration (as well as other methods of alternative dispute resolution) in lieu of litigation. The panel, consisting of experienced construction attorneys and a senior executive from the American Arbitration Association, will address this trend and others, including, for example, how the arbitration process has changed since the advent of Covid-19, the increase/decrease in hearings, mediations before arbitrations, settlements, etc.

Death and Divorce

This program will address the very difficult circumstances surrounding a death in divorce. The speakers will examine the conflict between the elective share and equitable distribution and the pending legislation to fix the black hole. They will also delve into the definition of “psychological parent,” and discuss how to address a change in custody when the custodial parent dies. They will also look at financial issues, such as what happens if the ex-spouse does not have the life insurance required per the settlement agreement upon their death, whether to charge against the estate for the surviving former spouse and children, and what to do if assets were not all transferred prior to death. Finally, they will discuss language to put in an agreement to protect your client in the event of death.

The Keys to Confidence in the Courts - What Lawyers Can Do

According to a 2021 survey conducted by the National Center for State Courts’ poll, only 6 out of 10 people have some or a great deal of confidence in their state courts, a 10% drop from 3 years ago. More recent surveys and polling paint an even darker picture. The United States is the world’s greatest democracy. Yet, we are facing a challenging time. The Director of the Annenberg Public Policy Center (APPC) at the University of Pennsylvania recently stated that, based on recent surveys of the Center, respect for judicial independence appears to be eroding. Some is due to the persistent and growing polarization in America and the undermining of the courts by those political extremes. Both Justice Scalia and Justice Ginsberg were approved by the Senate in votes of 90+ and only a few against. Yet, in the last few years, Justices were approved by a slim majority along party lines.   
Some is due to a lack of civics education and understanding of the Court’s function and its place in the proper functioning of our country. Trust in the Courts is essential to the proper functioning of our government. What can lawyers do to educate the public and engender trust? Join an esteemed retired assignment judge and respected attorneys as they discuss some of the causes of the erosion of trust and what we can do to help safeguard this essential institution.

Less than a year ago, the NJSBA’s Putting Lawyers First Task Force issued a survey to all members to measure attorney well-being. The survey results reported that New Jersey lawyers are suffering from record levels of burnout, depression, suicidal ideation, substance use disorders, anxiety, and thoughts of leaving the profession multiple times higher than in other working populations. Live Wire? The Use of Workplace Impairment Recognition Experts and Other Methods to Determine Cannabis Impairment in the Workplace

On April 21, 2022, New Jersey licensed dispensaries began sales of legalized adult-use Cannabis. Coupled with the longer-standing Medicinal Cannabis Program, New Jersey employers are confronted with novel issues related to determining impairment in the workplace.
    
The Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (“CREAMMA”) dictates that employers are prohibited from taking adverse action against employees based solely on the presence of cannabinoid metabolites.
    
CREAMMA further mandates that an employer use a “Workplace Impairment Recognition Expert” (“WIRE”) to determine Cannabis impairment. To accomplish this goal, CREAMMA tasks the Cannabis Regulatory Commission (“CRC”) to establish standards for WIRE certification.
    
On September 9, 2022, the CRC issued interim guidance regarding its understanding of CREAMMA’s requirements and the lawful steps Garden State employers must undertake to determine Cannabis impairment.
    
To date, the CRC has not devised (1) a WIRE training curriculum; or (2) announced the cost, if any, for certification. Until the CRC finalizes the specifics of WIRE certification, employers shall not be required to perform a physical evaluation to substantiate suspicion of Cannabis impairment in the workplace.
    
The interplay between Cannabis statutes, regulations, and guidance is a witch’s brew of confusion which invites nuanced questions of whether CREAMMA provides a private right of action and, if so, consideration of implications for employee protection and employer obligations.
    
This panel will survey the current legal landscape regarding Cannabis impairment, consider public policy implications of the WIRE, and offer prescriptive guidance for the cautiously confused.

The Mental Health Diversion Program

This seminar will focus on the proposed legislation to establish a Mental Health Diversion program. The purpose of the program is to divert “eligible persons away from the criminal justice system and into appropriate case management and mental health services as early as possible following an interaction with law enforcement where the person is alleged to have committed an “eligible offense.”
    
This panel will discuss the current mental health programs and initiatives within the criminal justice system of New Jersey that are available to defendants who suffer from mental illness. The panel will discuss the initiatives that are active in Monmouth County and Essex County, when in the criminal process these programs can/should be applied to, the qualifications for applicants, the programs effect on the defendants' criminal case, and an overview of what is required of the defendants once in the program. Panelists from both county programs will discuss what about their programs is working, as well as what can be improved upon.
    
This panel will further discuss the proposed Mental Health Diversion Bill, S524, sponsored by Senators Teresa Ruiz and Sandra Cunningham. The goal of this proposed legislation is to create a Statewide Mental Health Diversion Program in three regions of the State to divert individuals with serious mental illnesses from having a public record of conviction or serving custodial time, to allow participants to engage in mental health treatment and social services, and to reduce recidivism, thereby increasing public safety.

Fire Spreading in Our Midst: The Urgency of Protecting Transgender and Non-Binary Adults, Youth, and Children

Transgender and non-binary people are uniquely situated in their vulnerability to systemic marginalization, social exclusion, and personal and systemic harms. Several factors contributed to the heightened risk of harm and violence that transgender and non-binary people face on a daily basis both individually and communally:

• Affirmation of one’s gender identity creates “a paper trail” that does not exist with the same risks and public exposure for cisgender people.
• Many transgender and non-binary people who affirm their gender identity rely on lifelong access to affirming healthcare.
• Limited financial resources for costly administrative and medical processes further marginalize transgender and non-binary people.
• Lack of understanding of gender identity further fuels anti-trans rhetoric and efforts to silence, invisibilize, and in some cases erase transgender and non-binary people from society.

The vast majority of widespread anti-trans efforts across the U.S. occur in spaces where most non-trans people take civil, constitutional, and human rights for granted: healthcare and education. Yet those efforts do not stop there. Anti-transgender and anti-nonbinary efforts in the form of legislation, public policy, and other governmental actions derive from a larger social agenda.  
   
Martin Niemöller, a Lutheran pastor who originally was a supporter of the Nazis and later was imprisoned for opposing the Nazi regime, once stated the following to explain how he came to be engaged in speaking out against the horrors of the Holocaust:
“First they came for the socialists, and I did not speak out—because I was not a socialist.
Then they came for the trade unionists, and I did not speak out—because I was not a trade unionist.
Then they came for the Jews, and I did not speak out—because I was not a Jew.
Then they came for me—and there was no one left to speak for me.”
     
Today, in the face of so many extreme efforts to dehumanize human beings whose identities and experiences may be different than our own, Niemöller’s words ring as a clarion call for all of us – particularly within the legal community – to be steadfast in standing with and for those who continue to be systemically marginalized in relation to their identities and lived experiences. With a focus on the current efforts across the United States to further marginalize transgender, non-binary and gender non-conforming adults, youth, and children, through legislation banning affirming healthcare and penalties for parents who affirm their children’s gender identity, this session will provide up to date information on the state of trans rights and legal challenges to fundamental civil rights and identification of steps lawyers can take – individually and collectively -- to support equality under the law and equity in the legal system for transgender, non-binary, and gender non-conforming people across the country including here in New Jersey. This session will include core cultural competency relating to gender identity and fundamental inclusive practices for judicial and legal practice.

Prosecuting Animal Cruelty Cases – Past, Present and Future

This program will review the law surrounding animal cruelty – past, present and future. There will be three main topics:  
1. The history of anti-cruelty statutes with a timeline of significant laws, societal trends that led to their passage, and the contributions of Henry Bergh, who drafted the New York statute and founded the ASPCA.
2. Current prosecutorial efforts to combat animal abuse in Jersey City. Jersey City has been pro-active in appointing and training Humane Law Enforcement Officers (HLEOs) to investigate and enforce animal cruelty laws.
3. A presentation by Senator Raymond Lesniak. Senator Lesniak will discuss courtroom animal advocacy laws and pending legislation. Senator Lesniak has been a vocal animal rights advocate throughout his career. He is the founder of the Lesniak Institute and has written a book entitled "Cultivating Justice in the Garden State."

First, the panel will discuss the law regarding access to student records and how that law changed when the New Jersey Department of Education issued clarifying regulations that granted the public access to redacted student records. Second, in 2022, the Supreme Court opened the door to accessing internal affairs reports; the panel will discuss the impact that decision has had on transparency and access to internal affairs records. Third, the panel will discuss significant amendments to the regulations of the Government Records Council that changed both GRC procedures and requestors’ substantive rights. Fourth, the panel will discuss other updates to OPRA not covered by the first three topics.

Join us for a unique presentation as Lisa Sarnoff Gochman, who briefed and argued the landmark sentencing case of Apprendi v. New Jersey, offers a “behind the scenes” perspective of United States Supreme Court litigation through her book, "At the Altar of the Appellate Gods." Lisa’s memoir traces the arc of a racially-motivated hate crime from the Cumberland County trial court, through the New Jersey appellate courts, and up to the United States Supreme Court in Washington, D.C., where Lisa defended the constitutionality of New Jersey’s Hate Crime Statute against an onslaught of questions by the nine Justices of the Rehnquist Court.

Who are “first generation” lawyers? They are the first in our families to have a professional career. They are immigrants or first generation in the US. and they possess various socio-economic backgrounds, life experiences, skills, and talents that diversify our New Jersey bar.  As the legal industry continues to focus more on issues of diversity, inclusion, and equality, it has become apparent that first generation lawyers have common issues regardless of social identity. The recognition of these commonalities has created this distinct diversity category.
     
It is also a fact that for the first time in history, up to five generations can find themselves working beside each other in a typical organization. The result? There can be division. Interactions among people from different generations can resemble a cross-cultural relationship. Both usually possess different values and customs. At times, each generation is literally speaking a different language!

Together, she and her law partner, Dwayne Swisher, represent defendants in complicated criminal cases. The books are known as the “Erin McCabe Series.”
    
While the characters are fictionalized, the legal strategy and lessons are real. Robyn will focus on the plot of her newest book, her experiences as a successful author, and what to expect from the fourth book that she is currently writing. Understanding the Impact of Racial Trauma:  Supporting the Mental Health of Minority Attorneys

Special Interest Track - Signature  
Racial trauma, also referred to as race-based traumatic stress (RBTS), is defined as emotional and/or mental injury resulting from personal experiences with racism, racial bias, discrimination and/or hate crimes. Research indicates that emotionally painful racist encounters can lead to race-based traumatic stress injury for the individuals who experience them. Due to our country’s historic racial inequities and systemic injustices, Black Indigenous People of Color (BIPOC) in this country are the most vulnerable to suffering from RBTS. Racial and ethnic discrimination, however, is expansive and can have a detrimental impact on people of culturally diverse backgrounds as well as  the larger community. Studies show that people experiencing, sudden, continued and/or prolonged exposure to racism and racial discrimination can experience symptoms similar to post traumatic stress disorder (PTSD). Although race based traumatic stress (RBTS) is not considered a mental health disorder, it is considered an injury that can affect one’s mental health. Over the past two years attorneys have collectively experienced the trauma of dealing with the sudden and sustained impact of  the uncertainty of a global pandemic.  While trauma is real for attorneys in general,  the constant stress of navigating racism both externally and within the profession is a unique stressor for black and other attorneys of color.

Immigration law is unique among federal practices in the frequency with which clients’ diverse identities are not only relevant to, but stand at the very heart of, the legal issues at hand. Often, immigration attorneys are our clients’ first introduction to the United States legal system. The representation may well shape how clients view justice and the law in the United States going forward.
  
Given this particular significance, it is critical to recognize as practitioners how our unconscious biases may manifest at various points in a representation in ways that a client may or may not observe, but which nevertheless could directly impact their case. These may arise during initial consultations, communications with the client, the court, and other case parties, and drafting certifications/affidavits. Developing skills to recognize and manage these biases can improve our decision making, make us more effective in our practice, and help us identify situations where we can serve as upstanders to disrupt implicit bias in the immigration system.
  
This panel will address the nuts and bolts of attorney cultural competency and implicit bias in the practice of immigration law. In addition to providing helpful tools and scenarios for attorneys to consider in immigration contexts in particular, the program will introduce non-immigration law practitioners to the interplay of diverse client identities – including race, ethnicity, gender, gender identity, sexual orientation, religion, age and disability – in this inherently intersectional area of the law.

Landlord-Tenant Practice and Procedure in a Post-Pandemic Paradigm

The program will include intensive discussion about jurisdictional requirements and procedures for both nonpayment of rent actions as well as holdover actions (i.e.; notice cases). The speakers will discuss the timing and content of Notices to Cease and Notices to Quit, as well as what charges can be considered rent and when rent must be accepted. They will also review some issues vital for attorneys who represent tenants. These issues will include the components of New Jersey’s Rent Security Deposit Act, habitability hearings, as well as actions commenced by tenants for illegal lockout and wrongful eviction. In addition to these topics, the presenters will focus on changes to landlord tenant procedure in light of new rules that were enacted in 2021. These rules include several new forms, some changes to existing forms, and the implementation of case Management Conferences.

This program will explore the impact of working remotely on attorney growth and advancement, the training of young lawyers, and in particular women in the profession. While the availability of remote work has provided more flexibility and work/life balance, its allure tends to overshadow its possible detriments. The already existing difficulties for women in obtaining choice assignments, making client contacts, gaining promotions, and finding mentors, may be exacerbated if they are not truly “present.” We hope to increase awareness of and discuss how to meet these challenges in order not to lose the strides that have already been made. The program will also emphasize the importance of Bar Association activities, and other opportunities for in-person networking and collegiality, in our post-pandemic legal world.
