About The Program:

The Setting Every Community Up for Retirement Enhancement Act of 2019 (the SECURE Act) was signed into law in December and became effective on January 1, 2020. The act will have a wide-spread impact on retirement accounts and retirement planning as part of the estate planning processing.

The SECURE Act makes substantial changes that apply to both employers and employees. For employers, the Act makes retirement plans less expensive and less difficult to administer, thereby encouraging employers who have previously shied away from establishing and maintaining plans to offer them. For employees, it dramatically changes how benefits are paid to them and their beneficiaries.

Although the Act only became effective very recently, it is imperative that attorneys become proficient in understanding these new changes immediately, This is because it affects planning for the future and also necessitates a review of currently-existing estate plans so that beneficiaries don’t suffer from some of the negative tax consequents that can occur if some of the provisions are ignored.

Seasoned attorneys with expertise in tax and employee benefits law, estate planning and administration will take you through the most important provisions of the Act. They will explain the changes that were made, why they were made and a step-by-step guide to what you must do in order to protect your clients.

Topics to be discussed:

• Overview and goals of the Act- why it came to be and what are the retirement roadblocks it is
trying to remedy

• The significant changes to “safe-harbor” retirement plans.

• Why all estate plans with significant retirement assets must be reviewed in order to take
advantage of the Act

• The necessity of reviewing all currently existing trusts and what to look for, especially with
regard to the tax implications of the new “10 year rule,” which provides that beneficiaries of
inherited IRAs will generally need to withdraw all retirement moneys within 10 years after death.

• A panel discussion of the most frequently asked panning and administration issues that have
arisen since the Act’s enactment.
