The Keys to Confidence in the Courts - What Lawyers Can Do
According to a 2021 survey conducted by the National Center for State Courts’ poll, only 6 out of 10 people have some or a great deal of confidence in their state courts, a 10% drop from 3 years ago. More recent surveys and polling paint an even darker picture.
The United States is the world’s greatest democracy. Yet, we are facing a challenging time. The Director of the Annenberg Public Policy Center at the University of Pennsylvania recently stated that, based on recent surveys of the Center, respect for judicial independence appears to be eroding.
Some is due to the persistent and growing polarization in America and the undermining of the courts by those political extremes. Both Justice Scalia and Justice Ginsberg were approved by the Senate in votes of 90+ and only a few against. Yet, in the last few years, Justices were approved by a slim majority along party lines.
Some is due to a lack of civics education and understanding of the Court’s function and its place in the proper functioning of our country.
Trust in the Courts is essential to the proper functioning of our government. What can lawyers do to educate the public and engender trust? Since Robyn Gigl’s presentation at the 2022 Annual Meeting, one question has been on everyone’s mind – what’s next for Erin McCabe and Dwayne Swisher? We are about to find out! “Remain Silent” will hit the bookshelves in June, but Robyn will give us an inside look at the exciting plot and the legal issues surrounding Erin and Swish’s next adventure.
For anyone who hasn’t read “By Way of Sorrow” or “Survivor’s Guilt,” the main character is New Jersey attorney Erin McCabe. Erin is brave, brilliant, funny and transgender. Together, she and her partner Dwayne Swisher represent defendants in some of the most complicated criminal cases. The books are known as the “Erin McCabe Series.”
While the characters are fictionalized, the legal strategy and lessons are real. Robyn will focus on the plot of her newest book, her experiences as a successful author, and what to expect from the fourth book that she is currently writing. Then, a panel of judges and lawyers will discuss what we can learn from them to put to use in our real life practices.

This program will include intensive discussion about jurisdictional requirements and procedures for both nonpayment of rent actions as well as holdover actions (i.e.; notice cases). The speakers will discuss the timing and content of Notices to Cease and Notices to Quit, as well as what charges can be considered rent and when rent must be accepted.
They will also review some issues vital for attorneys who represent tenants. These issues will include the components of New Jersey’s Rent Security Deposit Act, habitability hearings, as well as actions commenced by tenants for illegal lockout and wrongful eviction.

Trends in Construction Arbitration

This program will provide some insights about construction arbitration and the trends that we have been experiencing since 2022. Given the backlog in state court trials, construction cases have to wait years for a jury trial. In light of this delay, as well as the cost involved in preparing and trying such a case, parties are turning to arbitration (as well as other methods of alternative dispute resolution) in lieu of litigation. The panel, consisting of experienced construction attorneys and a senior executive from the American Arbitration Association, will address this trend and others, including, for example, how the arbitration process has changed since the advent of Covid-19, the increase/decrease in hearings, mediations before arbitrations, settlements, etc.

Understanding the Impact of Racial Trauma: Supporting the Mental Health of Minority Attorneys

Racial trauma, also referred to as race-based traumatic stress (RBTS), is defined as emotional and/or mental injury resulting from personal experiences with racism, racial bias, discrimination and/or hate crimes. Research indicates that emotionally painful racist encounters can lead to race-based traumatic stress injury for the individuals who experience them. Due to our country’s historic racial inequities and systemic injustices, Black Indigenous People of Color in this country are the most vulnerable to suffering from RBTS. Racial and ethnic discrimination, however, is expansive and can have a detrimental impact on people of culturally diverse backgrounds as well as the larger community. Studies show that people experiencing, sudden, continued and/or prolonged exposure to racism and racial discrimination can experience symptoms similar to post traumatic stress disorder. Although RBTS is not considered a mental health disorder, it is considered an injury that can affect one’s mental health. Over the past two years attorneys have collectively experienced the trauma of dealing with the sudden and sustained impact of the uncertainty of a global pandemic. While trauma is real for attorneys in general, the constant stress of navigating racism both externally and within the profession is a unique stressor for black and other attorneys of color.

In a country where debates about permissibility and protections on the basis of sexual orientation and gender identity are regularly the subjects of state law—and rarely obtain the consensus required for embodiment in national law, immigration law is unique among federal practices in the relative frequency with which issues concerning sexual orientation and gender identity arise. Indeed, clients’ identities often stand at the very heart of the legal analysis. This program is aimed at introducing non-immigration law practitioners to how this inherently intersectional practice has approached the interplay of race, national origin, religion, and sexual orientation and gender identity.
Protecting Transgender and Non-Binary Youth

This is a follow up to a previous program called “Protecting Transgender and Non-Binary Youth.” This program covered issues of basic cultural competency regarding transgender and non-binary identity, the basic New Jersey and federal laws that provide protection for transgender and non-binary youth, and family law disputes involving transgender and non-binary youth.
This seminar will 1) address the state-level legislative assaults on gender-affirming care and gender expression throughout the country; and 2) bring in medical and psychological experts to dispel myths about gender-affirming care for minors, which are so rampant that they have even appeared in the New York Times late last year.
Attendees will benefit from this seminar even if they did not attend the other program.
Included in the roster of esteemed speakers are: Jodi Argentino, who will address the state-level legislative assaults on gender-affirming medical care; Robyn Gigl, author of two “banned books,” to discuss the censorship of trans and non-binary-themed literature in schools and libraries across the country as well as other forms of suppression of gender identity throughout the country such as the infamous “don’t say gay” law in Florida; Jackie Baras, RN, the Healthcare Navigator for the LGBTQIA Program at Robert Wood Johnson Medical Center to discuss the facts and fiction of trans-affirming care for minors; and Dr. Michele Angello, a psychologist specializing in care and treatment of transgender and gender non-conforming youth to speak about the mental health impact of laws that limit access to gender-affirming medical care and gender expression.

This program will address the very difficult circumstances surrounding a death in divorce. The speakers will examine the conflict between the elective share and equitable distribution and the pending legislation to fix the black hole. They will also delve into the definition of “psychological parent,” and discuss how to address a change in custody when the custodial parent dies. They will also look at financial issues, such as what happens if the ex-spouse does not have the life insurance required per the settlement agreement upon their death, whether to charge against the estate for the surviving former spouse and children, and what to do if assets were not all transferred prior to death. Finally, they will discuss language to put in an agreement to protect your client in the event of death such as:
• Language to ensure that family of deceased parent has rights to see child upon death of that parent
• Language to ensure that if life insurance is not maintained, it is a charge against the estate
• Language that says one parent is the parent of alternate residence – what that means

Natural disasters such as hurricanes, wildfires, and ice storms pose a significant threat not only to health and safety, but also to financial wellbeing. Individuals and businesses alike can suffer catastrophic economic losses as a result of a large-scale natural disaster, and the rise in natural disaster occurrences in recent years has impacted the insurance industry for both policyholders and insurers. While insurance coverage can be a useful tool in recovering from this type of loss, familiarity with the types of policies that may respond – and the potential roadblocks to coverage – is key to managing this resource. Prosecuting Animal Cruelty Cases – Past, Present and Future

This program will review the law surrounding animal cruelty – past, present and future. There will be three main topics:
1. The history of anti-cruelty statutes with a timeline of significant laws, societal trends that led to their passage, and the contributions of Henry Bergh, who drafted the New York statute and founded the ASPCA.
2. Current prosecutorial efforts to combat animal abuse in Jersey City. Jersey City has been pro-active in appointing and training Humane Law Enforcement Officers (HLEOs) to investigate and enforce animal cruelty laws.
3. A presentation by Senator Raymond Lesniak. Senator Lesniak will discuss courtroom animal advocacy laws and pending legislation. Senator Lesniak has been a vocal animal rights advocate throughout his career. He is the founder of the Lesniak Institute and has written a book entitled "Cultivating Justice in the Garden State."

The growing dominance of largely unregulated global tech companies presents grave concerns for lawmakers and regulators grappling with health, safety, and security issues such as cyber exploitation and discrimination, digital harassment and violence, online human trafficking, and biases and discrimination programmed into artificial intelligence and big data using powerful algorithms. While technology has benefits, it can also harm marginalized people—especially women and children and religious, ethnic and racial minorities — and threaten civil and human rights for all. Left unchecked, big tech amplifies all forms of discrimination and threatens the foundations of civil society and our collective humanity. This program will review the scope of the legal issues relations to cyber exploitation and how legislatures and law enforcement are responding to the changing legal landscape.

This program will explore the impact of working remotely on attorney growth and advancement, the training of young lawyers, and in particular women in the profession. While the availability of remote work has provided more flexibility and work/life balance, its allure tends to overshadow its possible detriments. The already existing difficulties for women in obtaining choice assignments, making client contacts, gaining promotions, and finding mentors, may be exacerbated if they are not truly “present.” We hope to increase awareness of and discuss how to meet these challenges in order not to lose the strides that have already been made. The program will also emphasize the importance of bar association activities, and other opportunities for in-person networking and collegiality, in our post-pandemic legal world.

Families who raise special needs children must not only plan for day-to-day challenges, but also for long-term needs. The financial challenges are many: paying for additional medical and counseling expenses, caregiver expenses, home modification costs, and providing financial support after the parents have passed away.
This program will focus on financial concerns for families with special needs children, including trusts and estates, other financial planning and how to do this all in the context of divorce and non-dissolution cases.
