Background:According to the HRSA (2019), in the majority of cases, vaccines cause no side effects - however they can occur. Very rarely, people experience more serious side effects, like allergic reactions. In those instances, the National Vaccine Injury Compensation Program (VICP) allows individuals to file a petition for compensation:
• Attorneys are eligible for reasonable attorneys’ fees, whether or not the petitioner is awarded compensation by the Court, if certain minimal requirements are met. In those circumstances, attorneys are paid by the VICP directly. • Almost 80% of all compensation awarded by the VICP comes as result of a negotiated settlement between the parties in which HHS has not concluded, based upon reviewof the evidence, that the alleged vaccine(s) caused the alleged injury.
Why You Need To Attend: Vaccine injury practice is a highly specialized area of practice in Federal Court, where all covered vaccine injury cases must be filed. The cases are adjudicated in the U.S. Court of Federal Claims in a highly structured program that differs greatly from typical state and federal courts and their rules of civil procedure.
Register today for this unique, useful, and easy-to-follow guide to the entire court and program structure, as well as the reality of vaccine injuries and the types of injuries that are frequently recognized in the vaccine court. As an attendee, you’ll learn how to discern which cases are automatically preempted vaccine injury claims (which must be filed in the U.S. Court of Federal Claims) and which are state specific products liability or medical malpractice claims. You’ll also be better prepared to handle this unique type of case when it comes your way.
