Join us to learn more about what we need to know regarding what’s new, and what we need to think more deeply about situations where we can use tools and techniques we have used before.

For those practitioners, developers, and members of government whose work focuses on redevelopment, this intermediate level seminar affords an opportunity to delve more deeply into some of issues being addressed in the context of redevelopment projects. The institute assumes a basic understanding of the local redevelopment and housing law and redevelopment generally.

With interest rates rising and inflating construction costs, we expect to see continued interest in public financing tools. Panel will explain public finance in redevelopment, including Redevelopment Area Bonds, providing developer, municipal, and State perspectives, and evaluating the need for such subsidies. Panel will include discussion on the types of projects that often qualify for such subsidies, associated State review, and structuring considerations, such as municipal credit enhancement, par amount of bonds, coordinating with incentive financing such as tax credits, and coordinating with mortgage financing.

Identifying legal and planning issues and debating how to address them. This panel will talk about, among other things, considerations when drafting and amending redevelopment plans, including the use of concept plans to ascertain what can be done under existing or proposed land and building requirements, addressing commonly encountered problems in redevelopment plans, the interplay between the plan and the zoning ordinance, deviations from plan requirements and variances from underlying zoning requirements that are applied when the plan is silent, and the continued viability/applicability of the plan when the project is completed.

80/20 Projects often grew out of declaratory judgment actions, implementing affordable housing zoning through redevelopment plans with affordable obligations included in redevelopment agreements, offsetting costs of affordable housing through financial agreements for payments in lieu of taxes and density bonuses, municipalities making progress toward achieving their fair share, funding inclusionary projects through LIHTCs, and what happens at the end of the 30 year affordable housing commitment term and creating new legal issues.
