Arbitration agreements are very popular with employers that hope that it will resolve employment disputes more quickly and less expensively than litigation in state or federal courts.

Although courts have increasingly favored enforcement of arbitration agreements, they have invalidated them for a variety of reasons including the lack of affirmative consent and notice, the failure to adequately disclose the waiver of a right to a jury trial and for limiting collective claims in violation of the National Labor Relations Act. Attorneys who draft and execute arbitration agreements on behalf of employers should do so with judicial scrutiny in mind. Attorneys for employees and labor unions should closely examine the language and mutuality
of the agreements.

This informative seminar reviews new, relevant case law and provides guidance for both defense and plaintiffs’ attorneys about how to draft, execute and challenge the arbitration agreements. Ethical issues related executing agreements and conducting arbitrations will also be discussed.
